Malta’s Individual Investor Programme - Citizenship and Passport


The Individual Investor Programme is designed to attract to Malta’s shores applicants who can share their talent, expertise and business connections. It is the first citizenship programme in the European Union to be recognized by the European Commission.
Applicants are subject to a thorough due diligence process which guarantees that only reputable applicants acquire Maltese citizenship. Moreover, applications from countries where international sanctions apply may not be accepted. Applications from a particular country can also be excluded on the basis of a Government policy decision.
Malta offers great opportunities to applicants of the IIP and their families, including a high standard of living, a stable political system and a robust economy.

The Individual Investor Programme of the Republic of Malta (IIP), by virtue of Legal Notice 47 of 2014, allows for the granting of citizenship by a certificate of naturalisation to individuals and their families who contribute to the economic and social development of Malta. Subject to a stringent vetting and diligence process, including thorough background checks, the applicants and their dependants are granted citizenship in exchange for such contribution.

To qualify for citizenship, the main applicant must be at least 18 years of age, provide proof of having been a resident of Malta for a period of 12 months preceding the issuing of a certificate of naturalisation and meet the following investment requirements:
• *The acquisition of real estate with a minimum value of EUR 350,000 to be held for at least 5 years; or
• *Lease a residential immovable property in Malta for a period of 5 years, at an annual rent of at least EUR 16,000; and
• Make a contribution to the National Development and Social Fund;
• An investment in stocks, bonds or special purpose vehicles to be identified by Identity Malta, for a minimum value of EUR 150,000 to be held for a minimum period of 5 years.

*Immovable property cannot be let or sublet.
Applicants must have a Global Health Insurance coverage for at least EUR 50,000 for the main applicant and each of the dependants and must give proof that they can maintain the same for an indefinite period.

Principal Applicants can include in their IIP application:

- Spouse – in a monogamous marriage or in another relationship having the same or similar status to marriage. 
- Dependants of 18 years of age and under. 
- Dependants between the age of 18 and 26 years of age, who are not married and who are wholly supported by the main applicant and form part of the household. 
- Dependants over the age of 55 years (e.g. parents), who are wholly supported by and who form part of the household of the main applicant. 
By virtue of the Legal Notice 47 of 2014, the Government of Malta has established the legal framework for the IIP, the process of application for the IIP is carried out through a Concessionaire, Accredited Persons or Approved Agents.

What's the cost of obtaining Citizenship?

The Contribution that must be paid under the IIP towards the National Development and Social Funds (NDSF) are the following:

EUR 650,000 for the Main Applicant [EUR 10,000 thereof is a non-refundable deposit that shall be paid prior to the submission of the application];
EUR 25,000 for the Spouse;
EUR 25,000 for every child below the age of 18;
EUR 50,000 for every unmarried child between the age of 18 and 26;
EUR 50,000 for every dependant parent above the age of 55.
The Due Diligence Fees payable to Identity Malta:

EUR 7,500 for the Main Applicant;
EUR 5,000 for the Spouse;
EUR 3,000 for every child between the age of 13 and 18;
EUR 5,000 for every unmarried child between the age of 18 and 26;
EUR 5,000 for every dependant parent above the age of 55.
Passport Fees

EUR 500 per passport.
Bank Charges

The bank charges fee due per application is of EUR 200.

The sum of EUR 10,000 is to be remitted as a non-refundable deposit, together with the official application and due diligence fees as well as the professional fees chargeable by the approved Maltese law firm of your choice.

Applications must be accompanied by supporting identification and verification documents authenticated in English, as set out in the Checklist and Guidelines, together with;

- Police conduct certificates;
- Proof that the main applicant has been a resident of Malta for a period of 12 months preceding Naturalisation;
- Medical certificates stating that the applicant and his dependants are not suffering from contagious diseases and are in good health
- An affidavit of support for each dependant who is over 18 years of age.

All applicants aged 18 years and over are obliged to attend in person in Malta to undertake the Oath of Allegiance.


MALTA RETIREMENT PROGRAMME

 
The Malta Retirement Programme (MRP) is a programme designed to attract nationals of the EU, EEA and Switzerland who are not in an employment relationship and are in receipt of a pension as their regular source of income. Individuals benefitting from this Programme may hold a non-executive post on the board of a company resident in Malta. This implies that the beneficiary would be prohibited from being employed by the company in any capacity.
Such individuals may also partake in activities related to any institution, trust or foundation of a public character and any other similar organisation or body of persons, which are also of a public character, that is engaged in philanthropic, educational or research and development work in Malta.

Malta Retirement Programme - Beneficial Tax Treatment
The beneficiary pays tax at 15% on income arising outside of Malta which is received in Malta with the possibility to claim double tax relief while any income arising in Malta is subject to tax at 35%.

Malta Retirement Programme – Eligibility
• hold a qualifying property occupied only by the applicant, family members and/or carers:
• purchased after 1st January 2011 situated either in Malta for a value of €275,000 or situated in Gozo for a value of €250,000;
• Special concession: where the property is purchased before 1st January 2011, such value as at date of application should not be lower than the abovementioned values (architect’s evaluation must be produced) 
• or rents a qualifying property of at least €9,600 per annum for a property situated in Malta or €8,750 per annum for a property situated in Gozo;
• Receive the whole amount of a pension in Malta, which pension constitutes at least 75% of the beneficiary’s chargeable income;
• not be a national of Malta or a third country;
• not be domiciled in Malta and does not intend to establish his domicile in Malta within 5 years from application date;
• not benefit under any other Malt Special Tax Status or be in employment;
• Be in possession of sickness insurance in respect of all risks across the whole of the European Union normally covered for Maltese Nationals for himself and his dependents;
• Be in possession of a valid travel documents;
• Be a fit and proper person.

Minimum Malta Tax
• Minimum tax of €7,500;
• An additional minimum tax of €500 per dependant and every special carer.

Malta Retirement Programme - Annual Obligations
In order to maintain one's special tax status, a Malta retirement programme status holder needs to: 
• Retain qualifying property holding (as defined above);
• Retain the necessary insurance;
• Retain in Malta for more than 90 days a year averaged over a period of five years;
• Not stay in any other jurisdiction for more than 183 days;
• Adhere to all special reporting obligations and notifications. 

Application Process for the Malta Retirement Programme
Applications for special tax status under the Malta Retirement Programme rules are to be made to the Government of Malta through any Maltese Authorised Registered Mandatory. We are in connection with offices authorised and regulated by the Government of Malta to handle and submit applications for residence permits under the various residence programmes available under Maltese Law.
